Months after certifying the petition to put “school choice” in front of general election voters this November, the Secretary of State is now reviewing a request to remove it from the ballot.

State Sen. Lou Ann Linehan of Elkhorn sent a letter Monday asking Bob Evnen’s office to remove LB753 from the November ballot on the grounds that repealing a bill already passed by the Legislature violates Nebraska’s constitution — and calls into question the Unicameral’s ability to set policy affecting the state’s income.

“While I respect the petition process including the power of referendum, if this existing revenue measure adopted by the Legislature can be repealed by referendum, the ability to set revenue policy would be undermined,” Linehan said in a letter sent to Evnen’s office on Tuesday.
